How to analyze your situation regarding a prenuptial agreement

Are you interested in creating a prenuptial agreement before your wedding day? Regardless of if you've discussed this with your soon to be spouse, there are many details you need to consider before moving forward.

Above all else, make sure the pros outweigh the cons. Along with this, do your best to have a meaningful conversation with your partner about the benefits of creating a prenuptial agreement. After all, both of you need to be on the same page.

If you're trying to decide if a prenuptial agreement is right for you, here are some basic questions to answer:

-- Do you own real estate that you will be bringing into the marriage?

-- In addition to real estate, do you have other valuable assets?

-- Do you own a stake in a business?

-- What is your annual salary? Is it more than $100k?

-- Do you receive employment benefits such as profit sharing or stock options?

-- Were you previously married?

-- Do you have children from a past marriage?

If you and/or your partner answered yes to several of these questions, there's a good chance that a prenuptial agreement could be right for you. It doesn't mean you absolutely have to create this agreement, but it's definitely something to consider.

Since there are things you can and cannot include in a prenuptial agreement, you need to sit down with a legal professional and hash out the finer details. When you move forward with the idea that you're doing what's best for both individuals, you'll feel better about the future.
